Why are Lawsuits Necessary?

Lawsuits are are necessary for several reasons.  This first reason would be the resolution of disputes.  Lawsuits provide a formal mechanism to resolve disputes that cannot be settled by negotiation or other means.  When parties cannot reach a solution to a dispute, a lawsuit is the only method to bring the matter to a resolution.

A second reason lawsuits are necessary is the enforcment of legal rights.  When a party believes their rights have been violated, a lawsuit is a way to seek enforcement of the rights or compensation for damages.  In civil case, plaintiffs often seek monetary damages.  A lawsuit is the path to either a jury trial or a court trial that can result in an award of monetary damages.

A third reason is the broader issues a lawsuit addresses such as challenging the constitutionality of laws or setting legal precedents.  These challenges and precedents can influence public policy.  In situations of widespread harm, class action suits seek to address the victims collectively and seek justice that may not be possible on an individual level.

Lawsuits take time and resources.  However, in many cases they are the only way to address grievances, enforce rights and achieve justice.
